Introduction

Arpenteur is an SARL (French limited liability company) with capital of €55,020 and its head office at 53 rue Montesquieu, 69007 Lyon – France, registered at the Lyon RCS under number 531 887 321, intra-community VAT number FR44531887321 (hereafter “the Seller”). Arpenteur is engaged in an e-commerce activity and offers an online sale services of products (hereafter “the Product(s)”) on the www.arpenteur.fr website (hereafter “the Site”) to non-professional consumer purchasers (hereafter “the Customer”).

The following Terms and Conditions present the rights and obligations of the Seller and the Customer within the framework of the online sale of the Products (hereafter “the Order”) available on the www.arpenteur.fr website.

Prior to any transaction, the Customer declares having taken note of these Terms and Conditions and expressly declares their acceptance by clicking on the “Validate” button when paying for his/her Order.

Furthermore, the Customer declares being fully aware that his/her acceptance of the content of these Terms and Conditions does not require the written signature of this document, as the Customer wishes to order the Products presented in the Site’s e-shop online.
 

Order registration and confirmation

The Site is freely accessible without registration. However, the Customer will be required to register to place an Order. During his/her first Order, the Customer will have to create his/her online account by providing his/her personal data. The Customer must ensure his/her data is always up to date and accurate.

The Seller reserves the right to close a Customer account should the Customer be in violation of applicable law, these Terms and Conditions, or any other terms, conditions, guidelines or policies of Arpenteur SARL.

Upon finalising his/her Order, the Customer will receive a confirmation email as soon as possible, titled “Arpenteur order confirmation”, acknowledging the Order and presenting the entirety of the information relating to it. Upon registering to the Site, the Customer must therefore provide a valid email address when filling in the fields relating to his/her identity.

Upon receiving the Order, the Seller will check the availability of the Product(s) ordered. Should a Product ordered by the Customer be unavailable, the Seller commits to informing the Customer by email within 5 working days following the Order. In case of unavailability, the Seller commits to offering the Customer either an exchange or a refund within 30 days following the Order. The remainder of the Order will be shipped under normal conditions in compliance with the “Order shipping” article below.

Furthermore, the Seller reserves the right to refuse an Order for any reason, in particular relating to the Order, an irregular order, a foreseeable problem with regard to the delivery, or a dispute relating to a previous order. In this situation, the Seller will inform the Customer within 5 working days following the registration of the Order, and will promptly proceed to refund the Customer within 30 days following the Order.
 

Order shipping

The Seller commits to shipping the Order as of 3 working days following its registration, and within 30 days at most.

The Customer can cancel his/her Order at no cost by emailing the Seller should this deadline be exceeded by more than 7 days (excluding force majeure cases). The Seller commits to promptly refunding the Customer, and within 30 days at most following the exercise of this right.

Once the Seller has shipped the Order, the Customer will receive an email titled “Your Arpenteur order has been shipped” which presents the shipping information for the Product(s).

All Products are shipped via DHL Express to the shipping address indicated by the Customer and delivered against signature by the recipient.

Shipping costs are fixed and based on the shipping address provided by the Customer.

The approximate shipping deadlines as of the day of shipping from the Seller’s address are available for consultation on our Delivery and returns section.

These deadlines are provided for information purposes only by DHL Express and shall not entail any liability on the part of the Seller. The Customer can therefore not cancel the Order, nor request compensation from the Seller, in any form whatsoever, should these deadlines not be met by DHL Express.

Furthermore, neither the Seller nor DHL Express shall be liable should the delivery be made impossible due to an inaccuracy in the shipping address provided by the Customer.
 

Offer validity

The offers presented by the Seller on the www.arpenteur.fr site are valid so long as they are visible on the Site, subject to availability. Product pictures and descriptions are provided for information purposes only, and may be edited with no impact on the Seller’s liability or the legality of the sale.
 

Prices

All prices indicated on the Site are given in Euro, inclusive of VAT, and exclusive of shipping and customs costs, which will be paid by the Customer. In this framework, the Seller refuses to under-assess the value of the Products on shipping documents.

The Order will be billed in Euro.

When an Order is delivered to a French or European Union address, the Product(s) and shipping costs are subject to a 20% VAT, as indicated on the Order summary and bill. For deliveries to any other location, neither the Product(s) nor the shipping costs will be subject to VAT, which will be deducted from the total amount of the Order upon its finalisation.

Arpenteur reserves the right to change its prices at any time, but commits to applying the prices in force at the time the Product(s) were ordered, subject to their availability at said date.
 

Payment conditions

Orders will be paid by Visa, MasterCard, and American Express credit/debit card on a secure payment server.

All banking data is secured via an SSL certificate and no data is transferred unencrypted on the Seller’s network. Payments take place directly on the payment page of the Seller’s banking organisation. None of this data will be accessible to Arpenteur SARL and its servers.
 

Cancellations

Every Order is subject to a cancellation request. The Customer has 30 clear days following the pick-up date to return the parcel. Items must be returned in their original state and packaging, with their accessories, and shall under no circumstances be worn, washed, ironed, altered or dirtied.

Returned Product(s) that do not meet these requirements will not be accepted by the Seller and returned to the Customer, at his/her expense.

Returned parcels must be marked “RETURNED MERCHANDISE” with a €0 customs value to avoid any processing costs and delays on re-importation. Should these instructions not be followed by the Customer, re-importation costs claimed against the Seller will not be refunded to the Customer.

The Customer is entitled to request a Product exchange or refund from the Seller.

A Product exchange is possible on same reference items in a different size. However, the exchange remains subject to approval by the Seller, and the shipping will be paid by the Customer.

Refunds will be credited by the Seller to the bank account used for the purchase of the returned item.

In the case of any non-conformity between the ordered and the delivered Product(s), the Customer has 3 working days after the pick-up date to inform the Seller. No claims will be accepted past this deadline.

Returns will take place at the Customer’s initiative, convenience, and expense, unless otherwise decided by the Seller. Failure to provide a tracking number will void the return.

In the absence of claims or reservations on the part of the Customer, the Product(s) delivered will be considered satisfactory and no subsequent claims will be accepted.
 

French Data Protection Act (loi “informatique et libertés”)

Arpenteur SARL has registered the file with the personal data of www.arpenteur.fr customers to the French National Data Protection Commission (CNIL) under No. 2165363, in compliance with the French Data Protection Act of 6 January 1978. The Seller commits to never share the Customer’s personal data with third parties without the Customer’s prior consent. This data will be used by the Seller’s internal services for the processing of the Order and the communication of its brands’ news only.
In compliance with this act, the Customer has the right to access, amend or request the deletion of their personal data. The Customer can do so by accessing the “My Account” section of the Site, or by sending an email to info@arpenteur.fr
 

Intellectual property

Arpenteur SARL is the sole proprietor of the entirety of the content on the www.arpenteur.fr website. The Customer shall not reproduce, download, or copy this content without the explicit authorisation of Arpenteur SARL.
 

Governing law

These Terms and Conditions are governed by French law. In the case of a legal dispute, the relevant French courts will have exclusive jurisdiction.

The Seller reserves the right to modify certain elements of these Terms & Conditions at any time.
